One of the most curious peculiarities of employment law that has always fascinated me is the expression: 'expressed or implied'. Expressed is easy, but what is 'implied,\" really?
Industrial relations, of course, is really just human relations played out in an employment context. So much, in any human relationship is implied, rather than expressed.
A shared and sustained eye contact can express something in a relationship that words cannot. Even a fleeting glance that meets another may convey a shared understanding especially when accompanied with a smile, a lifted eyebrow, or a parental or marital frown that does not need further expression.
When it comes to a contract of employment, however, it is usually better and safer, to ensure that, if it is a contract that is intended to last any length of time and be carried out to the satisfaction of the parties involved, particularly if there is a 'consideration' attached, it should be expressed, 'orally or in writing.'
If it is not, the terms, including the amount and the currency in which the 'consideration' is to be paid, may become a source of contention and end up in court.
Among the terms in an employment contract that are 'implied' are those that, in common law are referred to as a duty of co-operation.
It means that everyone who decides to enter into an employment relationship is agreeing to do all those things, even if they are not spelled out, that need to be done to achieve the objectives of the job.
Think of it. There are things that anyone taking on a job should not need to be told, for example: not to interfere with someone else's work, not to deliberately waste materials or destroy equipment, to obey reasonable instructions given by one's manager or supervisor, and to do 'a fair day's work for a fair day's pay.\"
On the employer's side, the implied terms are a 'fair day's pay for a fair day's work', ensuring that the employee understands and has the training to perform the required duties (learn and earn), making sure that there are sufficient and adequate tools and equipment to perform the requested duties.
These may sound like common sense, but the reason they have passed into common law is because they often are not common. If your mother didn't teach you that you are expected to dress properly in turning up to work, you might, like one young woman did, turn up to work in a bank, bra-less and in a very transparent blouse, much to the amusement of her supervisor who sent her home, but not before asking her to report to four senior managers for confirmation that she was in breach of company policy.
Not wearing a tiny bikini or a transparent outfit to work is not spelled out in most employment contracts, nor legislated for in Parliament.
There is a hierarchy of laws. The Constitution comes first, then laws followed by regulations, followed by laws and regulations legislated in Parliament.

TRINIDAD AND Tobago's Nicholas Paul finished fourth in the men's keirin final, on Thursday, on the second day of the UCI Track Cycling World Championships at Roubaix, France.
Paul was third, behind the Netherlands' pair of Olympic gold medallist Harrie Lavreysen and Jeffrey Hoogland, with three laps to go. However, Paul was unable to overtake the Dutch duo as the tempo increased.
Lavreysen was victorious in 10.027 seconds, with Hoogland second and Russia's Mikhail Iakovlev third.
Paul had to settle for fourth spot, with Kento Yamasaki of Japan and Rayan Helal of France trailing.
In the opening heat, Paul topped the field of six cyclists in 10.02 seconds to affirm a spot in the second round. Placing second and also advancing from this heat was Paul's World Cycling Centre training partner Jair Tjon En Fa from Suriname.
Into the second round, Paul placed second in heat one behind Lavreysen (Netherlands) to affirm a spot in the medal race.
In the men's scratch race, TT's Akil Campbell was one of three riders who were eliminated from the field of 22, along with Martin Chren of Slovakia and Yacine Chalel of Algeria.
Donavan Grondin of France took gold, followed by Tuur Dens of Belgium and Rhys Britton of Great Britain.
The Championships will run until Sunday.

SPEAKER of the House of Representatives Bridgid Annisette-George temporarily suspended an extraordinary sitting of the House of Representatives on Thursday, after repeated interruptions and claims by Opposition MPs that the proceedings were dictatorial.
The MPs complained they were being denied the right to speak on a motion, filed by Opposition Leader Kamla Persad-Bissessar, for the appointment of a tribunal to investigate the removal of President Paula-Mae Weekes from office.
Persad-Bissessar's motion is in relation to events that led to the collapse of the Police Service Commission (PSC) last month, and the failure of a merit list of candidates for a commissioner of police (CoP) to be sent to the House for consideration.
As the sitting got under way around 10.30 am, Annisette-George sought to address questions raised by Persad-Bissessar about no debate being allowed on the motion in accordance with Section 36 of the Constitution which allows for the establishment of the tribunal.
She also sought to raise questions of bias levelled against her and Independent Senator Charrise Seepersad, by Persad-Bissessar. Seepersad is the sister of former PSC chairman Bliss Seepersad.
Annisette-George said it was not her intention to address the sitting, but the questions raised by Persad-Bissessar warranted that she respond. But as she tried to address the matters raised by Persad-Bissessar, she was repeatedly interrupted by complaints from UNC MPs about what authority she had to make her statements, and that attempts were being made to silence the Opposition.
In the midst of the repeated interjections from MPs Rudranath Indarsingh, Anita Haynes, Rodney Charles, Saddam Hosein and Dinesh Rambally, Annisette-George said there were some motions, such as those which fall under Section 36 of the Constitution, on which debate is not allowed and all MPs, including Persad-Bissessar knew this.
As Opposition MPs continued to complain, Annisette-George suspended the sitting for 15 minutes.
Earlier, St Augustine MP Khadijah Ameen complained the Opposition's MPs microphones were being shut off and Annisette-George was delaying the sitting.
