SUSPENDED High Court judge Justice Erica Ndewere filed an application seeking the recusal of fellow High Court judge Justice Benjamini Chikowero from hearing her urgent chamber application and challenging Chief Justice Luke Malaba’s move to have her investigated over allegations of gross misconduct. BY CHARLES LAITON Justice Ndewere appeared before Justice Chikowero seeking to have President Emmerson Mnangagwa set aside the tribunal that he appointed last week to investigate her suitability to hold office. A week ago, Justice Moses Foroma was forced to recuse himself from the matter after Justice Ndewere’s lawyer, Beatrice Mtetwa, questioned the impartiality of a sitting judge to preside over a matter involving a colleague. Justice Ndewere is challenging the setting up of the tribunal on the basis that Chief Justice Malaba must first appoint an internal disciplinary hearing committee to which she intends to present evidence to exonerate herself. She is denying the charge of incompetence and is alleging victimisation by the Chief Justice. Justice Ndewere yesterday asked Justice Chikowero to recuse himself from hearing her case, with Mtetwa telling the judge that he could be a witness to the tribunal because he was one of the two judges that Justice Ndewere confided in after she had been threatened by Chief Justice Malaba. Mtetwa told the court that in 2019, Justice Ndewere informed Justice Chikowero in the presence of another judge at a conference in Vumba that Chief Justice Malaba had threatened to “investigate” her after she refused to accept his instruction to deny former Public Service minister Priscah Mupfumira bail. Mtetwa also told the court that Justice Chikowero’s name appeared on the memorandum from Chief Justice Malaba to Judge President George Chiweshe dated February 6 2019 which listed 10 judges the Chief Justice alleged were not doing their work. Justice Ndewere said Justice Chikowero was aware that the “facts” in that memorandum were disputed by the judges and were later withdrawn and that he may also be called as a witness to the tribunal in that regard. Mtetwa argued that the application before Justice Chikowero was challenging the discrimination against her client because Justice Ndewere was singled out for investigation and dismissal from a list of 10 judges and Justice Chikowero was a beneficiary of the discrimination against her. “Justice Chikowero cannot adjudicate on the matter because he is grossly conflicted,” Mtetwa argued, adding that he was Justice Ndewere’s pair judge for the urgent roll in the High Court where they worked together during evenings and weekends. She said Justice Chikowero should not hear her case because of collegiality. However, she said she would not insist on this point if collegiality was not important to the judge. PRESIDENT Emmerson Mnangagwa’s son, Tarirai David Mnangagwa is being accused of seizing gold mining claims in Gweru after the owners had invited him to invest in the project. The gold mining claims in question are under Block 16 Quarts mining claims called Jilikin 25, registration number 12641BM whose owner, according to court papers seen by NewsDay, is Chad Cecil Mupandanyama, since 2005. BY STAFF REPORTER But last month, Mnangagwa filed an application with the court, alleging that he had been duped of US$4 million by Mupanganyama after he was booted out a company which he co-founded. Mupandanyama together with his company, Swifteagle Investment Business Consultancy (Pvt) Ltd, cited Eliazel Mushiringi, Tarirai David Mnangagwa, Ruan Meats Enterprises (Pvt) Ltd, Wozheri Stone Crushers (Pvt) Ltd, Registrar of Companies, provincial mining director, Mines minister Winston Chitando as co-respondents in the matter. Mupandanyama said initially, he was partners with Mushiringi, who later roped in Mnangagwa to register a company called Wozheri Stone Crushers (Pvt) Ltd using a forged signature and other documents obtained fraudulently. As a result, Mupandanyama is seeking the High Court to issue an order declaring the registration of Wozheri Stone Crushers unlawful. Mupandanyama is also seeking the cancellation of the memorandum of agreement entered into between Mushiringi and Mnangagwa on November 28, 2017. “… and consequently, that the first to the fourth defendant’s (Eliazel Mushiringi, Tarirai David Mnangagwa, Ruan Meats Enterprises, Wozheri Stone Crushers) together with their sub-tenants, assignees, invitees, members and all other persons claiming occupation through them should within 10 days of service of this court order vacate from the mining claim,” Mupandanyama said in his affidavit. According to Mupandanyama, the drama started on January 7, 2016, when he entered into a tribute agreement with Mushiringi in terms of which he (Mupandanyama) agreed to grant mining rights to Mushiringi to develop, extract, mill and treat ore from the same and dispose of the product for own account. “In terms of the agreement first defendant (Mushiringi) undertook to pay 5% of the total gross value of gold and/or any other valuable product extracted from the said mining location,” he said. On March 18, 2016, Mupandanyama said Mushiringi entered into another agreement with Mnangagwa in terms of which he agreed to give up his mining rights, which he was exercising by virtue of the tribute agreement with Mupandanyama, to Swifteagle. This included installation of a granite crushing plant, payment of council fees, mine inspection fees, transport, food, accommodation, site fencing, costs of assaying and application of certificates. “The second plaintiff (Swifteagle) paid a commitment fee of US$10 000 to the first defendant and the agreement will be expiring in March 2036,” he said. Three Guinean opposition figures surrendered to the police on Thursday after being put on a wanted list for their alleged role in post-election violence, one of their lawyers said.
Officers questioned Ousmane Gaoual Diallo, Abdoulaye Bah - both members of Guinea's leading opposition party, UFDG - and Etienne Soropogui separately, lawyer Salifou Beavogui said.
Police on Wednesday also arrested UFDG vice president Ibrahima Cherif Bah as part of a sweep targeting mainly opposition politicians and activists.
At a press conference on Thursday, opposition leader Cellou Diallo called for their immediate release.
The arrests came after President Alpha Conde, 82, won a controversial third term after topping an October 18 poll with 59.5 percent of the votes.
The country slipped into violence in the aftermath of the poll, when UFDG leader Cellou Dalein Diallo, 68, proclaimed himself victorious and alleged voter fraud.
The government said at least 21 people died in subsequent clashes between Diallo supporters and security forces. The UFDG party put the death toll at 46, however.
While observers from other African countries have backed the official election results, France, the European Union, and the United States have cast doubt.
In a statement on Tuesday, a public prosecutor in the capital Conakry said police had detained or tried 137 people.
It said police were actively searching for six people accused of having made \"threats likely to disturb public security and order\".
Ousmane Gaoual Diallo, Abdoulaye Bah, and Etienne Soropogui were among those six people. Only Soropogui, who is from a minor opposition party, is not a UFDG member.
Ibrahima Cherif Bah was also on the wanted list.
Political tension in Guinea centers on Conde's third term, against which there have been rolling protests since October 2019.
The president pushed through a new constitution in March which he argued would modernize the country. But it also allowed him to bypass a two-term limit for presidents.
A former opposition leader, Conde became Guinea's first democratically-elected president in 2010 and won re-election in 2015, but critics accuse him of veering towards authoritarianism.

Zimbabwe Christian Alliance representative Mehlokazulu Ncube said the proposed Bill would affect innocent children. “This thing is against the Constitution of Zimbabwe and my question is why is Parliament pushing such an agenda? We elected parliamentarians to stand for us and it is their duty to deny such Bills which do not promote ubuntu and are against the Constitution,” Ncube said. “What have they done as parliamentarians to educate children and if this Bill is passed, where are they going to get money to buy these things when as a country we have a serious deficit?” A resident, Patricia Chininge, said most of the parents were not helping their children with issues of reproduction. “The society morality has broken down from parents to children and now there are so many child-headed families, but as a society and the government, we have failed to help those children and they end up being exposed to sex and other things,” she said. “Is giving children this type of education the only solution? I am totally against the Bill. Let’s rise up as the society, as the government as the people and find a solution to deal with this problem. The problem is that children are having sex at an early stage. There is no guidance, there is no education, so let’s bring better ways to deal with that.” Baptist Union of Zimbabwe member Godwin Moyo said the Bill seemed to put everything in one basket. “There are problems that are there concerning early pregnancies, child-headed families, but the solution is the one that we are saying no to,” he said. Nkulumane MP Kucaca Phulu said people had not properly understood the Bill. “The young people are having their own angle of understanding and the elderly are having their own interpretation. So, I wish to get time and have more discussions with both the youths and the elderly,” he said. Former Health and Child Care minister David Parirenyatwa said they were sent by Parliament to gather public views. “As you can see, most of the parents and churches are saying ‘no, 12 years is still too young, they are too immature. We are really leading them into child prostitution’ and they are also challenging the age of consent,” he said. “The youths are saying, ‘let everyone have reproductive healthcare’ and so this is the discussion we were having. The parents’ morale is very low and parents have been complaining that not enough consultation was done. We should have consulted teachers, churches, parents and youths separately and I agree with them.”

Chin’ono, however, is arguing that his tweets do not constitute an offence as he was merely performing his duty as a journalist. He refused to name his sources from the National Prosecuting Authority, whom he claimed had told him that the State was not going to oppose Rushwaya bail, saying he was exercising his journalistic privilege. Chin’ono, who is being represented by Beatrice Mtetwa and Gift Mtisi, filed an application for a bail and awaits ruling from Magistrate Marehwanazvo Gofa today. A NYANGA man committed suicide after he was accused of raping and impregnating his minor sister. The man (26, name withheld) of Gohoto village under Chief Katerere in Ruwangwe, Nyanga North, killed himself on November 6. It is said that on November 5, the family members of the now-deceased met and discussed the matter as they accused him of impregnating his 14-year-old sister. The following day, the accused told his son that he was going to Nyapomboro Mountain. The family members became suspicious when he failed to return after several hours.
