BY DESMOND CHINGARANDE JOURNALIST Hopewell Chin’ono, who is accused of inciting the public to commit public violence, has filed an application for the recusal of the presiding magistrate Nyasha Nduna. Chin’ono, who was represented by Gift Mtisi and Doug Coltart, elected to file a written application before the clerk of court and oral submissions later. Coltart said Chin’ono had numerous applications which he was supposed to file before the Harare magistrates, adding that their first step was to seek Nduna’s recusal. “The defence wishes to apply for your recusal from this matter. We want to file the application in writing and we commit to file that application by today. We want this application to be dealt with this week,” Coltart said. But the State led by Whisper Mabhaudhi and Tendai Shonhayi said Chin’ono’s application was not urgent. “The accused person did not give the reason why he wants the removal of the magistrate. He conceded that the application is not urgent by considering the matter next week. We can even file our response on November 2 for oral submission,” Mabhaudhi said. Nduna, however, in his ruling on the application for postponement by the State said Chin’ono’s matter was not urgent and that there was no evidence submitted in relation to the application. “It is lawful for the accused to make such an application, but the court is cognisant of the fact that once a person is allocated a case, that person should handle the case properly to finality. Accused person is not rendering evidence to the court that his lawyer Advocate Taona Nyamakura is going to undergo examination out of the country,” Nduna said. “The accused did not also produce any form of documentary evidence that he seeks to undergo toxicology tests in South Africa. This shows that the application may not be serious.” He said the State also had a right to study the application in order to make a meaningful response and that the accused person had the right to be represented by a lawyer of his choice. Nduna said the earliest date for hearing of the application was November 2. The State and defence then agreed to file their written submissions for the application by close of business tomorrow and the State will respond by October 28. Nduna recently made headlines after denying Chin’ono bail twice and turning down the journalist’s several other court applications. He also stopped Chin’ono’s lead counsel Beatrice Mtetwa from representing him, saying she had interfered with court processes.
By NQOBANI NDLOVU OPPOSITION parties have snubbed the invitation extended to them by government to attend the State-organised anti-sanctions musical e-gala scheduled for Bulawayo this Saturday, describing the event as a waste of resources. The e-gala is part of several events lined up to commemorate the Anti-Sanctions Day scheduled for October 25, which has since been declared a public holiday. This year’s commemorations will be held under the theme: 'Resilience, Progress and Solidarity under an Environment of Sanctions.” Southern African Development Community (Sadc) member countries last year pledged to commemorate the event each year in solidarity with Zimbabwe as part of efforts to pressure the United States government to drop its targeted sanctions against Harare. The sanctions were imposed at the turn of the century in response to then President Robert Mugabe’s land reform programme and gross human rights abuses. The US government has, however, maintained some of the restrictive measures to force the Zanu PF administration to introduce a wide range of reforms. Local opposition parties have, however, refused to be part of the commemorations, blaming the Zanu PF government of inviting the restrictions by disrespecting citizens’ rights. Opposition parties and traditional leaders in Matabeleland region have refused to denounce the sanctions, saying the restrictions should only be lifted after government has implemented reforms demanded by the international community. “We do not have time for nonsense. The biggest sanctions are Zanu PF’s abuse of State apparatus for personal political gain. That alone is a sanction on the people of Zimbabwe,” MDC Alliance provincial spokesperson Swithern Chirowodza said. “Corruption that knows no bounds within government, extra-judicial murders, abductions and torture of people who hold different views is another sanction on the people of Zimbabwe.” Zapu Bulawayo provincial spokesperson Patrick Ndlovu said the gala was a waste of resources. “If they are there (sanctions), they do not need a gala. Sanctions need reforms, good corporate governance and the like. As Zapu, we feel this is a waste of resources which could have been channelled elsewhere,” Ndlovu said. MDC-T acting spokesperson Khaliphani Phugeni said the party had not made a decision yet about its participation. Information permanent secretary Ndavaningi Mangwana on Monday invited all parties to attend the event. “We have joined hands with other progressive stakeholders such as business, political parties and civil society to hold this year’s anti-sanctions e-gala. We extend an invitation to the MDC-T, MDC Alliance and others to come and give a shout against sanctions,” Mangwana tweeted. BY KENNETH NYANGANI Energy minister Zhemu Soda has said the lack of energy efficiency awareness among citizens has forced the country to import more energy than required, costing the country millions in foreign currency. Soda made the remarks in Mutare yesterday in an address read on his behalf at the national energy efficiency policy development consultative stakeholder workshop. “Previous studies on the status of energy efficiency in Zimbabwe by various organisations have shown that we use old and antiquated equipment in the residential sector, in industry as well as the mining sector, resulting in low energy efficiency levels,” he said. “Energy efficiency awareness by our citizens was also reported to be lacking, leading to unnecessary energy losses in terms of both electricity and fuel that the country cannot afford.” He added: “As a result, there is need for demand side management and energy efficiency measures to be put in place in order to save energy, thereby reducing imports and also resulting in savings on foreign currency. “This exercise is part of an overall national energy policy initiative that seeks to create an enabling environment for making clean and affordable energy accessible to all in an upper-middle income economy of 2030.” Zimbabwe has in the past months been subjected to long hours of load-shedding. “Besides efforts by the government and its utilities, it has been noted that inefficient use of energy is still prevalent in many households and institutions. This is shown by the type of machines, gadgets and lighting in use,” Soda said. “The government has so far put a number of measures in place to promote a culture of energy saving in the country.” The measures include the banning of inefficient lighting through a Statutory Instrument in 2017, gazetting of Solar Water Heating Regulations for new buildings through SI 235 of 2019, installation of prepayment meters, awareness activities through various media and exhibitions and introduction of a reactive tariff for industry. Soda said the power and fuel supply situation had greatly improved compared to last year.

In a statement, police spokesperson Assistant Commissioner Paul Nyathi said Charumbira contravened section 174 of the Criminal Law (Codification and Reform) Act Chapter 9:23 when she unprocedurally approved a sub-division of land which had been set aside for other purposes without authority from Local Government, Public Works and Urban Development minister July Moyo. “The matter came to light following a tip-off which was received by police and prompted investigations into the matter. The suspect will appear in court soon,” he said. “The Zimbabwe Republic Police will leave no stone unturned in the quest to account for all people involved in illegal land allocation and other criminal activities.” Charumbira, who is wife of president of the Chiefs’ Council Fortune Charumbira, is alleged to have irregularly changed land use plan for open spaces in Sunningdale and along Samora Machel Avenue and allocated the land to “friends” at the expense of the deserving public. The land in Sunningdale was parcelled to Metro Peech wholesale while service stations were set up on residential land along Samora Machel Avenue without change of land use authority sometime in 2016. The Sunningdale land was reserved for recreational facilities, but was unprocedurally turned into a commercial zone. Charumbira was also accused of unprocedurally allocating an open space opposite Harare Quarry to one Chisvo.

Well-functioning stock markets enable economic growth and development by facilitating the mobilisation of financial resources and by bringing together those who need capital to innovate and grow, with those who have resources to invest. They do this within an environment that is regulated, secure and transparent Exchanges also seek to promote good corporate governance amongst their listed issuers, encouraging transparency, accountability and respect for the rights of shareholders and key stakeholders. However, despite playing a crucial role, the link between exchanges and economic development is not widely-understood or appreciated. Without stock markets, businesses would largely resort to borrowing huge loans from banks or individuals with well-oiled pockets which must be repaid with interest. Fortunately, businesses in both the developed and developing world can issue shares to the public, raising vast amounts of cash that doesn’t come along with a repayment burden (public companies are under no obligation to pay dividends, especially when they incur losses). When businesses have access to such capital, they can easily expand their operations and create more job opportunities. From a national perspective, this will lower unemployment levels, and enable a government to earn move revenue from business taxes. Stock markets provide a trading platform for governments too. Sometimes a local, state or national government may need more money to develop a community housing estate, build a water treatment plant or initiate any other public projects. Instead of increasing taxes to raise the required revenue, it can issue bonds through the stock market. When investors buy these bonds, the government is able to raise the money it needs to launch various projects that can ease the cost of living or even create jobs for locals. In the long run, this improves the economy. Investments, whether in the financial markets or product markets (agriculture, real estate, manufacturing etc.), are a key driver for economic trade, growth and prosperity. As governments focus on creating policies like lowering interest rates that promote a culture of investment, stock markets are gaining prominence as a top destination for investors. Increasingly, more people are looking to invest in companies with growth potential. guest column:Tadiwa Pasipanodya THIS article serves as a brief synopsis of the mining that was taking place in one of Zimbabwe’s protected areas namely Hwange National Park. The article will start with an in-depth analysis of the laws that regulate the mining industry in Zimbabwe and then proceed to discuss the current unenviable situation which has seen mining take place in a national park. It will then conclude on a sombre note as it discusses the conflict between environmental conservation and the need to stimulate economic growth, moreso in a situation where there is a desperate need to achieve the latter. What law regulates mining in Zimbabwe and what are the procedures contained in the law? The main piece of legislation that regulates mining in Zimbabwe is the Mines and Minerals Act (hereafter referred to as the Act). The first aspect one would note when perusing through it, would be that in section 2, the Act vests the right to mine in the President of course subject to the Act. Although this is not the main purpose of this piece, it would be worth noting how more progressive jurisdictions have handled this key introductory section. For instance, in South Africa the Mineral and Petroleum Resources Development Act (MPRDA) enlists the State as the custodian of mineral resources for the benefit of all South Africans. That is a notable distinction which will be explored on another day. For one to start mining in Zimbabwe, the following procedures must be satisfied. The process naturally starts with a prospecting licence. In the Hwange National Park instance, the Chinese-owned company by the name Yuxian County Zhingxin Coking Company Ltd (hereafter referred to as the Chinese company) which was working in conjunction with the Zimbabwe Mining Development Corporation (ZMDC), was supposed to be in possession of a Zimbabwe Investment Authority certificate. Then in turn apply for a prospecting licence from the Mines ministry or any of its offices as prescribed by section 20 of the Act. Section 23 of the Act further provides that the prospecting licence will be valid for a period of two years and gives the holder the latitude of prospecting and pegging mining claims anywhere in Zimbabwe subject to certain limitations. At this point, the holder of the prospecting licence can go on to physically peg the area the prospector is interested in as prescribed by section 27 of the Act. However, this should happen after delivering prospecting notices to the land owner. There is a caveat, however, provided in section 31, namely that certain areas are not open to prospecting which, therefore, means they cannot be pegged. Such areas include dams and cultivated dip tanks. Once the requirements prescribed in the Act have been satisfied, individuals interested in mining can then move to apply for registration at the Mines and Mining Development ministry offices and the following must be attached: Prospecting licences, prospecting notice, discovery notice, notification of intention to prospect to the land owner, a map in triplicate to the
