BY MIRIAM MANGWAYA HARARE magistrate Marehwanazvo Gofa yesterday castigated Hopewell Chin’ono’s lawyer Beatrice Mtetwa for embarrassing State prosecutors after she told the court that corruption was stopping prosecutors from owning cars. This was after prosecutor Lancelot Mutsokoti had pleaded with the court to adjourn early so that they could be able to catch Zupco buses to ferry them home. “Your Worship, I pray that the court be adjourned, considering the predicament of many of us who rely on public transport so that we knock off early and we catch the Zupco buses,” he said. Mtetwa then interjected, saying: “If there was no corruption, they should have bought cars by now and will not be using public transport. I was a prosecutor and I bought a car in my first year of practice because there was no corruption.” Mutsokoti’s co-prosecutor Fungura Shambadzeni then asked the court to order Mtetwa to withdraw her statement. Gofa then ordered both the State and defence councils to meet her in her chambers over the matter. “Allow the court proceedings to run smoothly without humiliating each other. Meet me in my chambers. If you don’t come, I will bring this matter in this court,” she said. Addressing journalists outside the Harare Magistrates Court, Mtetwa said she withdrew the statement and apologised to the State since she had uttered them out of jest. Gofa dismissed Chin’ono’s application to be removed from remand, arguing that the tweet which he posted constituted an offence as it jeopardised the Judiciary system. Chin’ono is being accused of posting information that impaired the dignity, reputation and authority of the courts. Through his lawyers, Mtetwa and Gift Mtisi, Chin’ono yesterday applied for bail which was, however, opposed by the State. In challenging bail opposition by the State, Mtetwa said Chin’ono was eligible for bail since he was out of custody on another pending more serious case which attracted a five-year jail term. She also said the investigating officer, Naison Chirape, was opposing bail out of malice because Chin’ono had told the truth which the prosecution was not happy about. The bail hearing continues today.

BY KENNEDY NYAVAYA THE burial of the late fitness trainer-cum-model Michelle “Moana” Amuli could be delayed for about two weeks as the family has to follow a lengthy Deoxyribonucleic Acid (DNA) testing process to verify her remains after she was burnt beyond recognition in a freak accident on Sunday morning. The 26-year-old video vixen was in the company of controversial businessman Genius “Ginimbi” Kadungure whose Rolls-Royce Wraith II vehicle collided head-on with a Honda Fit along Borrowdale Road, Harare, while driving back to his Domboshava home. They were coming from Moana’s birthday party that was held at Ginimbi’s Club Dreams, formerly Sankayi in Harare’s avenues area. Also in the car was Limumba Karim, believed to be from Malawi and Alichia Adams believed to be from Mozambique who both perished in the accident. In an interview with NewsDay Life & Style yesterday, at the deceased's home in Highfield, Moana’s sister and family spokesperson Tatenda said the funeral arrangements had been thrown into disarray as her sister’s remains were holed up at Doves Funeral Parlour in Harare, awaiting DNA test results from Parirenyatwa. “We thought the body that we saw the day before yesterday (Sunday) was the one, but it was not. So today (yesterday) they refused to do another post-mortem, saying they will need to do DNAs tests which means that we have to wait two weeks,” she said. “We appealed for the process to be quickened and they promised to call us today (yesterday) to let us know if they can reconsider.” A family friend, only identified as Mai Karara pleaded with Moana’s influential friends to assist to speed up the DNA tests. “We have known her (Moana) since she was a child, the DNA process is too long and we cannot wait for weeks as it is too much time to mourn. I am, therefore, pleading with her friends, whoever she used to hang around with including all the famous people, so they can come and assist us to identify the body for her to rest,” she said. “We are appealing to the whole of Zimbabwe to help. These children died in a painful manner. So we are pleading with anyone because her mother’s state now is not so good and for her to stay like this is not right.” Since the passing on of Moana there have been different narratives about her life with interviews with the father and mother shading more light about her. “Those who know her as a celeb, they know her in that capacity, but for us she never changed, she was friendly to everyone. This is why you see that even local peers are here because she embraced everyone even when she became rich,” a neighbour said. By BLESSED MHLANGA ELECTORAL management body, Zimbabwe Electoral Commission (Zec) has washed its hands over the by-elections which Vice-President and Health minister Constantino Chiwenga embargoed citing the novel coronavirus, saying it cannot override an Executive decree. Speaking in Darwendale yesterday at a training workshop for journalists organised by Zec, the electoral body chairperson Justice Priscila Chigumba said the commission was just an administrative body with no power whatsoever to make policy or challenge the Executive. “The role of Zec is persuasive, when I say persuasive, from the Constitution to the Electoral Act, to the regulations our role is only to make recommendations to the Executive, there is no where we are given a mandate, firstly to make regulations on our own behalf. Secondly to make law, we make recommendations to government to the executive, to the line ministry which is the Ministry of Justice that’s the first very, very important point,” she said. Zec announced in October that it was ready to run all by-elections, adding that it would have run all by-elections by December 5, but in less than a week, through a statutory instrument, Chiwenga blocked all by elections. The Zimbabwe Human Rights Commission quickly moved in and issued a statement saying Zec’s actions could compromise its integrity and independence. Chigumba, however, said Zec had done its part in terms of the law and the rest was in the hands of Mnangagwa, who is a major player in the elections. “We are a commission which administers electoral law which emanates from Parliament, now if our stakeholders are unhappy with our mandate; it is up to them to buttonhole those in Parliament to change our mandate. “In terms of our current mandate, we recommend the Executive, His Excellency the President to say we believe by such and such a time, in terms of administrative processes, we will be ready to conduct by-elections,” Justice Chigumba said. “Having put this date in the public arena we made our recommendations to the President, he took our recommendations into account, he consulted other stakeholders including the Ministry of Health, I was not privy to the discussions between him and the Minister of Health, but I would like to assume that His Excellency using his executive powers and in his wisdom saw it fit to say by-elections cannot and should not be held during the course of this year.” She said her role did not go beyond making recommendations. “My role starts and ends will making recommendations. I made my recommendations, they were taken into consideration, I have no further role in terms of the Constitution to call upon the Executive and say on what basis did you disregard our recommendations, there is no provision for that in the Constitution,” she said. BY PATRICIA SIBANDA Pendulum Pharmaceuticals was launched at Ascot in Bulawayo yesterday after making the lifesaving donation at the hospital. Mpilo Hospital acting chief executive officer Solwayo Ngwenya told the media at the handover ceremony that the donation would go a long way in helping provide critical surgical services. “This donation is quite heavy, worth US$45 000 and the quantities are quite massive, they include guedel airways, these ones are used for anaesthetic operations to help patients breathe during anaesthesia, so they are lifesaving and also there are manual resuscitators for babies and these ones are used for emergency situations,” he said. “We also have large amounts of surgical bed sheets. These will help a lot in times of COVID-19. They will be used by patients to reduce infection rates and help fight COVID-19. We also received a vaginal speculum which we use to examine women and for cervical screening.” Ngwenya added: “It is indeed a wide variety of life-saving anaesthetic emergency room equipment, surgical beds cleanliness and infection control.” He said they were facing other challenges, but they were trying by all means to manage the situation. “The situation is always manageable, we buy and the government sends us regular supplies through NatPham. We also, as a hospital, use our own monies but this is going to be a big boost because it will allow us to divert some of the monies to buy other items that will be in short supply like N95 masks, things generally used in fighting COVID-19,” Ngwenya said. He said one of the major challenges was the malfunctioning of radiotherapy machines despite the promise made by government to have them fixed. Ngwenya said the hospital was experiencing an increase in the number of COVID-19 patients.
