Physicians for Human Rights (PHR) welcomes a \"landmark\" ruling by Kenya's High Court that ordered the government to pay compensation to four female survivors of a wave of sexual violence that unfurled after violently disputed elections in 2007.
The four will each receive the equivalent of around $36,000, while another four plaintiffs -- two women and two men -- had their cases dismissed.
The government was responsible for a \"failure to conduct independent and effective investigations and prosecutions of SGBV (sexual and gender-based violence)-related crimes during the post-election violence,\" the court said.
The result, it said, was a \"violation of their constitutional rights\".
Rights groups found that more than 1,100 people were killed and at least 900 people suffered sexual assaults, including gang rape and castration.
Years later, the International Criminal Court in The Hague indicted Kenya's President Uhuru Kenyatta and his deputy William Ruto for crimes against humanity, but both cases collapsed when witnesses failed to testify.
Physicians for Human Rights (PHR), a charity that helped bring Thursday's case to court, welcomed the \"landmark\" ruling, saying it was the first time in Kenya that post-election sexual violence has been recognised by the government, and compensation offered.
\"After more than seven years of litigation ad delays, some justice has finally been served,\" said Naitore Nyamu, head of PHR's Kenya office.
\"This is a historic day for survivors of the rampant sexual violence perpetrated in the aftermath of the 2007 election.\"
One of the compensated survivors said, \"We are happy that the court has finally recognised the harm that we suffered as victims. However, we do not understand why the court separated us and did not offer compensation for the other four victims.\"
Violence -- including sexual violence -- continues to be a staple of presidential elections in Kenya, where the next vote is due in August 2022.

Morocco basked in US recognition of its sovereignty over Western Sahara Friday after outgoing President Donald Trump changed policy on the decades-old dispute in return for Rabat agreeing to normalise relations with Israel.
For the Polisario Front, which has campaigned for independence for the former Spanish colony since the 1970s, Trump's announcement marked a major setback and drew a promise to fight on until Moroccan forces withdraw.
But crucially, there was no immediate reaction from neighbouring Algeria, Morocco's regional rival and the Polisario's key foreign backer, whose support would be essential for any return to major fighting.
Moroccan Foreign Minister Nasser Bourita hailed US recognition of Western Sahara's \"Moroccan identity\" as a \"historic diplomatic breakthrough\".
\"Several years of work\" had been \"crowned with the recognition of the United States, the major power on the (United Nations) Security Council,\" he told AFP in an interview.
Fellow permanent UNSC member Russia, historically close with Algeria, denounced the US move on Friday.
Deputy Foreign Minister Mikhail Bogdanov called the decision \"unilateral\" and \"a violation of international law\".

The State led by Prosecutor Edward Katsvairo, alleges that on October 5 the suspects went to El Shadayi Mine in Mazowe driving two cars, a Toyota Wish, registration number AFF 2894 and a Nissan Caravan registration number AFF 7099, which they parked in the bush and walked to the mine. Upon arrival, they saw the mine workers sleeping and assaulted them and those who tried to resist were pushed into the mine shaft. The quartet demanded gold ore from the miners which collected and packed it in sacks. The sped off in their cars. Mine workers regrouped and gave chase. The Caravan’s rear tire burst and the miners tried to apprehend the suspects, who were armed with unknown weapons. The miners filed a police report. Police officers acted swiftly and arrested the suspects.

BY MIRIAM MANGWAYA Harare City Council finance director Tendai Kwenda yesterday appeared in court on criminal abuse of office charges after he allegedly used council funds to purchase his personal vehicle. It is alleged that Kwenda transferred US$75 000 from the council beer levy account into his account and purchased a personal Jeep Cherokee motor vehicle without council approval. Kwenda was not asked to plead when he appeared before magistrate Ngoni Nduna, but was remanded in custody to December 24. His lawyer Joel Mambara said he would not apply for bail at the magistrates’ court, but at the High Court. Kwenda was arrested a week after he was released at the court on the same charges by magistrate Marehwanazvo Gofa, who said the charges were “meaningless and incomplete. His co-accused when he was first arrested Cainos Chingombe, council human capital director, was also re-arrested early this week and was in custody for using council funds to purchase personal vehicles. The State alleges that Kwenda did not follow the council procurement procedures that stipulate that council procurement exceeding $10 000 should be purchased through a tender process. He purchased the vehicle for $97 500 and topped up $27 500 from his personal funds. He insured the vehicle and demanded the money from council, which was reimbursed. The accused was then involved in an accident with the Jeep and made an insurance claim from Old Mutual, and bought a Land Cruiser that he registered in is name. The beer levy funds he used to purchase his personal vehicle with were not part of the general revenue of the local authority, but was to be used to fund the welfare of the community on provision of services such as health, water sanitation and others. ON December 9 2020, consumers and internet users nationwide struggled to access internet services as one of the biggest internet services provider ZOL Zimbabwe’s system was not working. The company issued a statement and this was one of the most widely felt disruptions of internet service platforms since the 2019 national internet shutdown. The disruptions had far-reaching implications on the provision of downstream services. In Zimbabwe, the ability to access critical services such as healthcare, education, banking and commerce can literally depend on the reliability of the internet at all times and the broader business online in the age of the global pandemic, COVID-19. Since the outbreak of the pandemic which limited face-to-face meetings, the majority of organisations are performing their business online. In 2016, the Information Communication Technology, and Cyber Security ministry issued the Postal and Telecommunications (Quality Services) Regulations. These quality service regulations apply to the quality of voice calls, SMS, internet and mobile data, customer services and postal services. It is not enough for both internet service providers (ISPs) and mobile network operators (MNOs), to blame system upgrades for prolonged interruptions of internet services. ISPs should uphold internet services standards to ensure that disruptions of internet services are minimised and consumer rights are protected while engaging on the platforms available. As Zimbabwe, as is the case with rest of the international community, grapples with containing the spread of the deadly COVID-19 pandemic, network resilience and responsiveness becomes a strategic national issue.
