LAWYERS representing incarcerated journalist Hopewell Chin’ono yesterday said there was nothing criminal about calling for change of government outside elections as that was how the late former President Robert Mugabe was removed from power in November 2017. BY MOSES MATENGA/HARRIET CHIKANDIWA/VENERANDA LANGA Chin’ono is being represented by Beatrice Mtetwa, Gift Mtisi and Doug Coltart in a case in which he is being accused of inciting public violence by calling for the ouster of the ruling Zanu PF party. He was arrested on Monday together with Transform Zimbabwe leader and July 31 protests organiser Jacob Ngarivhume who was yesterday remanded in custody to August 14. In cross-examining the investigating officer in the case of Chin’ono, Detective Assistant Inspector Edward Pedze, Mtetwa asked whether there was anything criminal about calling for peaceful protests and saying that #ZanuPFMustGo, citing the ouster of Mugabe as an example. Pedze failed to prove to the court that Chin’ono’s tweets incited violence, but insisted the tweet was inciting as it was calling for the removal of a government outside elections. He said only elections must remove a President or government from power, but Mtetwa immediately reminded him of the November 2017 coup saying there was no election when that took place. Mugabe was removed from power in November 2017 after a military intervention that was followed by peaceful protests and resignation of the former Zanu PF strongman. The Constitutional Court and the High Court endorsed Mugabe’s ouster as constitutional. Pedze initially professed ignorance on how Mugabe was removed from power before Mtetwa went to great lengths to remind him how the operation was carried out. After the reminder, Pedze agreed that the protests were constitutional, but refused to accept Chin’ono’s #ZanuPFMustGo tweets calling for the same cause as constitutional according to section 59 of the Constitution. He told the court that he had not seen or investigated protest flyers stating that the July 31 protests would be done observing the prescribed World Health Organisation guidelines following his concerns that Chin'ono's tweets exposed the public to the deadly COVID-19 pandemic. Chin’ono will only know of his fate today after court officials argued that they wanted to go home early before the 6pm curfew imposed by President Emmerson Mnangagwa. Mtetwa was furious after the adjournment saying the move by the court was “frustrating” and uncalled for. Mtetwa registered complaints against the police, which included the illegal nature of the arrest as evidenced by the violent manner in which it was effected, resulting in broken glass from the sliding door (at Chin'ono's home). Failure by the arresting officers to identify themselves. Failure by the police officers upon his arrest to inform him of his rights and delay in informing him of the charges that were being laid against him. THE burial of late fitness trainer, video vixen and model Michelle “Moana” Amuli was stopped at the 11th hour yesterday as family wrangles took centre stage. BY KENNEDY NYAVAYA Her burial was initially set for Wednesday at Zororo Park Cemetery along Seke Road and was later moved to yesterday, before being called off again as her parents could not agree on religious rites and burial site. Moana died in a horrific accident last week that also claimed the lives of socialite Genius “Ginimbi” Kadungure, Malawian businessman Limumba Karim and Mozambican model Alicha Adams. While Ginimbi was buried in style on Saturday, Moana’s burial has been delayed by endless fueds between her parents who are on separation. Moana’s maternal Uncle Austin Chimedza confirmed the chaos saying they had resolved to have the burial order cancelled until the matter is finalised. “The Amuli family has changed goalposts on us because we had agreed on how we were going to conduct the funeral, so we are not happy with that,” he said. “They also went to get the burial order, but we want to get it cancelled because they have changed all our plans including where she will be buried because we had bought a grave at Zororo Cemetery, but they now want to bury her at Warren Hills.” On Wednesday, dramatic scenes characterised a meeting between both parties which ended in a stalemate as Moana’s father, Ishmael and his family refused to process the burial order if their wishes to conduct Muslim rites were not granted. This resulted in the shelving of the initial plans to conduct a church service at Doves funeral parlour before a night vigil in Highfield ahead of the abandoned burial. Her maternal side had organised a drive to the accident scene along Borrowdale Road before proceeding to Highfield. Meanwhile, Doves Holdings said despite the squabbles it would play its part since it had an obligation to do so. “We charge for the service and since we have not done it yet, we are still going to carry out the burial tomorrow,” said Doves Holdings spokesperson Innocent Tshuma.

Recent mobilizations of the Black community in reaction to the shooting deaths of unarmed Black men demonstrate that we can have an impact on the course of actions by officials of the criminal justice system.

Today, the criminal justice system in Minnesota is being used to control and weaken the Black and American Indian communities by making felons a very large segment of the Black and Indian male populations.

Turning the Black community against Itself

Perhaps the greatest immediate danger to the social fabric of the Black community is the criminal “justice” system.

The social dysfunctions in the depressed areas of the ghetto can be largely attributed to the anti-Black functions of the criminal justice system, which operates to debilitate the Black community by making felons out of a large proportion of Black men who then prey largely on members of their community- “Black-on-Black” crime.

Racial profiling is a tactic used in the strategy of the criminal justice system to maintain the subordination of Black people.

The National Convention of Colored Citizens which met in Buffalo, New York from August 15 to 19, 1843 is best remembered as the venue for the speech by Rev. Henry Highland Garnet calling on the slaves to “throw off their chains.” However the chair of the convention, Samuel H. Davis of Buffalo, also gave an important oration calling on African Americans, particularly those who had been enslaved, to make known our wrongs to the world and to our oppressors. That speech appears below.

GENTLEMEN: I consider this a most happy period in our history, when we as a people are in some degree awake to a sense of our condition and are determined no longer to submit tamely and silently to wear the galling yoke of oppression, under which we have so long suffered—oppression riveted upon us, as well by an unholy and cruel prejudice, as by unjust and unequal legislation. More particularly do I consider it ominous of good, when I see here collected, so much of wisdom and talent, from different parts of this great nation, collected here to deliberate upon the wisest and best methods by which we may seek a redress of those grievances which most sorely oppress us as a people.

Gentlemen, in behalf of my fellow citizens of Buffalo, I bid you welcome, from the East and West, the North and South, to our city. Among you are the men who are lately from that part of our country where they see our brethren bound and manacled, suffering and bleeding, under the hand of the tyrant, who holds in one hand the Constitution of the United States, which guarantees freedom and equal rights to every citizen, and in the other the scourge dripping with gore, drawn from the veins of his fellow man. Here also are those who live in my native New England, among the descendants of the pilgrims, whose laws are more in accordance with the principles of freedom and equal rights, so that but few laws are found recorded on their statute books of which we need complain. The enemy in the central theatre is the self proclaimed \"Renamo Military Junta\", which rejects the peace agreement signed last year by President Filipe Nyusi and Renamo leader Ossufo Momade, and which has carried out a string of murderous ambushes on the main roads in Manica and Sofala provinces.

The other four officials sworn in, are the director of Neto's office, Lt-Col Alberto Magudo, the director of the communications department in the general staff of the armed forces, Commodore Anibal Rafael Chefe, the delegate of the Nampula Provincal Recritment and Mobilisation Centre, Lt-Col Cipriano Pio, and the Commander of the Chokwe Productive Unit of the Civic Service, Lt-Col Gil Ganhane.

Maciacona was an officer from the ranks of the former rebel movement Renamo, and his appointment, in January 2019, was part of the agreements between the government and Renamo.

Chefe is also a former Renamo officer, and Neto told reporters his appointment is part of the process of the demobilisation, disarming and reintegration (DDR) of Renamo's armed force, a proces regarded as crucial for achieving a lasting peace in Mozambique.

Chefe's appointment is the first public act in the contaxt of DDR since August last year.
